Terms of Service

Effective Date: April 17, 2026.

These Terms of Service ("Terms") form a legally binding agreement between you and VINOS DEL SUR LLC ("Vino Santo Bistro"). By creating an account, subscribing, or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to create an account or place an order. By using the service you confirm you meet this requirement.

2. Accounts

You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at info@vinosantobistro.com if you suspect unauthorized use.

3. Subscription and billing

Vino Santo Bistro offers two paid plans: Monthly ($9.99 per month) and Annual ($59.99 per year). Your paid plan begins immediately following the 30-day free trial unless you cancel before the trial ends.

3.1 Automatic renewal

Your subscription renews automatically at the end of each billing period (monthly or annual) at the then-current rate until you cancel. We will charge your payment method on file at the start of each renewal cycle. If the payment fails, your access may be paused until a new payment method is provided.

3.2 How to cancel

You can cancel at any time from the My Kitchen page. Cancellation takes effect at the end of the current billing period; you keep access until that date. You can also cancel by emailing info@vinosantobistro.com. We do not charge cancellation fees.

3.3 Price changes

We may change subscription prices. If we do, we will give at least 30 days notice by email before the change takes effect. If you do not accept the new price you can cancel before the change takes effect.

4. Physical goods

Kitchen goods ordered from the store are subject to our Refund Policy. Prices are shown in US dollars and do not include tax or shipping unless expressly stated.

5. Intellectual property

All recipes, text, images, videos, and course materials on Vino Santo Bistro are owned by VINOS DEL SUR LLC or our licensors. You may cook the recipes for personal use and share them with friends. You may not republish, redistribute, or resell the content without our written permission. Our logo, brand name, and photography are trademarks of VINOS DEL SUR LLC.

6. User conduct

You agree not to: (a) use the service for any unlawful purpose, (b) attempt to breach security or access data that is not yours, (c) scrape, reverse engineer, or systematically copy the site, or (d) abuse or harass our staff or community members.

7. Disclaimers

The service is provided "as is" and "as available". We make reasonable efforts to keep the site working correctly, but we do not warrant that it will be uninterrupted or error-free. Recipes assume reasonable skill, food safety knowledge, and awareness of your own allergies.

8. Limitation of liability

To the maximum extent permitted by applicable law, our aggregate liability under these Terms will not exceed the amounts paid by you to us in the twelve months before the claim arose. We are not liable for indirect, incidental, special, or consequential damages.

9. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Disputes shall be resolved in the state or federal courts located in Hillsborough County, Florida, except where arbitration is required below.

10. Arbitration and class action waiver

Any dispute arising out of or related to these Terms or the service will be resolved through final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in Tampa, Florida, or by telephone. You and we each waive the right to participate in a class, collective, or representative action. You may opt out of this arbitration provision within 30 days of creating an account by emailing info@vinosantobistro.com with "Arbitration Opt-out" in the subject line.

11. Changes

We may update these Terms. If material changes are made, we will post notice on the site and, where required, notify you by email at least 30 days before the change takes effect.
